A (in) eficácia da ressocialização a partir do método APAC

Abstract

This monograph seeks to analyze whether the Brazilian prisons fulfill one of the objectives of the custodial sentence, to rehabilitate the person of the convicted and thus, to present an alternative method to the criminal execution. Initially, it is approached about the concept of rehabilitation, demonstrating that it is not a simple reintegration of the prisoner in society, but rather that it is necessary to observe other factors such as the socialization of the subject. Subsequently, it is demonstrated the barriers that prevent rehabilitation from taking place, making evident the clear contradiction between the law and its your effective application. In a second moment there is the analysis of the pen, starting with an explanation of its emergence as a simple form of punishment until reaching a humanized perspective of fulfillment of sentence. Following is the theories and functions of the pen pointing out how they are supposed to work and how they actually work. Finally, it is exposed what would be the Association for the Protection and Assistance of the Convicted (APAC) and whether it, in its entirety, is capable of rehabilitate the individual.
