“Seu corpo, minhas regras”: um estudo sobre a pornografia de vingança na delegacia especial da mulher de São Luís-MA

Abstract

This work’s central theme is to analyze the new legal treatment to the crime of revenge pornography as domestic and family violence based on the criterion of effectiveness in its prevention. The objective of this study was to trace a panoramic exhibition of the virtual environment as a potential space of violence, highlighting the trends of approach and aggression perpetuated in the space, analyzing the main aspects of the crime and its characteristics. From its understanding as gender violence, the demonstration of the manifestation of male domination over the control of the female body, as well as the extent of damage to the lives of victims. It also understands the strength of the cyberspace as a place of manifestation of feminisms and vehicle of awareness for women. It was analyzed the relationship of patriarchy in several areas of experience, including in the judiciary boosting institutional violence and the problem of legal monism in its undue tendency towards criminal responses to social problems, as well as the failure of punitive power to protect victims. The patriarchy, as a system of domination above all institutions, reflects its ideas in the judicial and legislative systems, thus the environment of state protection for women becomes a space for replication of violence. Therefore, even with the specific laws in force, is it indispensable to understand whether: the justice system has been effective in curbing a woman’s vulnerability to revenge pornography? Considering that the punitive power as a reproducer of patriarchy tends to make even more revenge porn assaulted more vulnerable, the hypothesis that legal response to the problem has not been efficient in preventing new conduct is being worked on. In order to develop this study, exploratory and dialectical materialist method were adopted as a type of research. From this, the objective was achieved through data available in pre-existing researches on the internet and real cases in São Luís, state of Maranhão – Brazil, and its metropolitan area. Thus, the results point out the importance of a network and basic work to contain these violent behaviors.
