Fake news: riscos ao processo democrático e influência no pleito eleitoral São Luís

Abstract

The fake news phenomenon has been gaining focus over the years, and we owe that especially due to technological advances, to constant search for information and the number bigger each time of internet’s users. With the advent of this new way of communication, there were the necessity of regulatory itself to bring legal security when using it. That’s why, the Electoral Right adapted the already existing law so that the candidates could make their propaganda on more vehicles. Thus, the objective is to analyze if the dissemination of the fake news can influence or manipulate the public opinion and show hazards to the democratic process, changing the electoral pleading, such as showing on how the fake news operate on the virtual environment, the regulation of the election propaganda on the internet and expatiate if the fake news used as a massive way may characterize abuse of economic power and so, occasion an AIJE (Electronic Judicial Investigation Action) with effects depending on the moment of its precedence, making the candidate ineligible. So, the research is characterized as exploratory, qualitative, documental, and has as a scientific method, the deductive. By the end, in case there is any dissemination of fake news trying to harm the pleading, there must be a punishment to the ones involved on the civil and criminal scope.
