Restorative justice and the right to free sexual orientation and expression of gender identity: an analysis of the treatment of the LGBT issue in the Socio-educational Centers of Intention in the State of Maranhão

Abstract

This paper analyzes the treatment given to adolescents within the institutions administered by the Children and Adolescents Foundation (FUNAC) in the state of Maranhão, on how reception takes place in environments of deprivation and restriction of freedom and guarantees of fundamental rights, schooling and sexual diversity. Because it is a multidisciplinary field, the research is exploratory in nature, bringing the hypothetical-deductive approach method, which is part of the documentary and bibliographic analysis, is pertinent when investigating the role of the State in the democratization of fundamental rights, among which is gender diversity. Finally , field research was used through structured interviews with

adolescents in deprivation or restriction of freedom in the scope of the Socio- educational Units of the Island of São Luís, through a questionnaire structured

applied from March to November of the year 2020.In that regard, the present work still sought to verify if there is a financial limitation state, as ineffectiveness may be linked to changing political will according to the dominant ideological strand at each moment, building the means of control as instruments for so that fundamental rights are achieved.
