Trabalho infantil/trabalho de crianças e adolescentes: uma busca por dignidade e efetivação de direitos fundamentais sociais

Abstract

The objective of this work is to highlight the denied dignity towards working children and teenagers. Point out their social fundamental rights, especially how the Social Security works towards in the effectiveness of dignity and the principle to protect them. Initially, treating the constitutionalisation rights of children and adolescents and the exchanges of the paradigm according the new criteria of the Estatuto da Criança e Adolescente-ECA, demonstrating basic concepts and brief historical contexts approaching international and constitutional agreements, such as the main infra-constitucional rules that regulate the matter such as the Consolidation of Labor Laws- CLT, the ECA and the learning law along many other statements along this dissertation. Also dealing about the working rights (dignity of the human being and the principles of integral protection and the social security). Highlighting the social welfare market database which utilizes the child labour. An analyses with with refined numbers from the IBGE, showing the most common forms which are socially accepted, as well as the legal authorized and demonstration the very worst ways of child labour. Finalizing with a analysis from the constitucional legal order and the effectiveness of the principals to help working children and teenagers, outlining analogies demonstrating the legalization of the rights that were restricted to “protect”, and carry out the human dignity and the fundamental social rights for the working children and adolescents, contributing with social security (social welfare, social and health assistance) not just for the young labourers, but also for the entire society. It can help with the eradication of child labour, avoid judicial cases and easier resolution of problems as well to relieving congestion in the system and once more accomplish the constitutional principles of integrity and dignity of child labour in order to the social well-being.
