A responsabilidade civil na relação entre o estado-administração e o titular de serventia cartorária: o elemento obrigacional solidariedade

Abstract

The theme of Civil Responsibility finds several nuances, mainly from the perspective of objective accountability, a contemporary theoretical meaning that dominates discussions in academic and jurisprudential circles. Aware of this, the present work initially lends itself to study the essential elements, pillars on which Civil Liability is built, as the analysis of each and every facet of this origin will demand the constant rescue of these basic principles. Alongside these premises, it will identify the systems by which the State's accountability was governed and will verify specificities and legal consequences arising from the relationship by which state agents are linked to the State-Administration. Finally, it will identify the system applicable to notary agents, through the analysis of the historical evolution of legislative diplomas and the applicable jurisprudence, in particular of the superior courts, in order to qualify the meaning of responsibility for which these agents will be subject and verify the existence of the characteristic of solidarity in the relationship between the Registrar and the State-Administration.
