O arquivamento do inquérito policial e a Lei no 13.964/19: uma análise da sua repercussão à luz do sistema acusatório

Abstract

Crime is a constant concern in many societies, and Brazil is no exception to this reality. In this challenging scenario, Bill No. 13,964/19, also known as the Anti-Crime Package, emerged, with the main objective of establishing stricter measures against corruption, organized crime and violent crimes in Brazil. Among several devices that have changed due to the new legislation, art. 28 of the Code of Criminal Procedure, which deals specifically with the procedure for archiving the police investigation. In view of this, this work problematized the implications resulting from the archiving of the police investigation carried out solely by the Public Ministry, with the general objective of analyzing its repercussion in the light of the procedural system adopted in Brazil. Methodologically, an exploratory and descriptive research was carried out, with a qualitative approach and inductive method, gathering information from bibliographic research. As a result, it was noted that the changes promoted in the systematic archiving of the police investigation emphasize the procedural system adopted in the Brazilian legal system, in addition to impacting the impartiality of the judging body, as well as the performance of the Public Ministry, approaching this form of a democratic rule of law.
