Infância perdida: o retrato da criança e do adolescente no contexto de facções criminosas em São Luís/MA à luz da criminologia crítica

Abstract

Over the years, the process of creation and development of a child and adolescent solidifies and becomes, depending on the case, more delicate, since during that time, there are a series of discoveries in the search for self-knowledge, so that understands their space in social coexistence. In this process, there is the possibility of this child or young person deviating from their path and entering illicit paths. From this perspective, this work aims to analyze the involvement of children and adolescents in criminal factions in the light of Critical Criminology. In its methodology, the qualitative approach and deductive method were used, with bibliographical research, as it seeks to establish a connection between the problem and its reasons, and the inductive method, in which such research is based on the particularity of children and adolescents and their relationship with criminal factions and is external to the general nature of the criminal acts carried out. Furthermore, the objectives reflected throughout the work are shown in the chapters. The first deals with adolescents in the context of an infraction in light of the legal system. The second about the feeling of belonging they feel when joining criminal factions based on the analysis of Critical Criminology. The third deals with the public security crisis with the advent of criminal factions. In view of this, it was found that the factors that lead children and adolescents to join these factions have a strong connection with social inequality, marginalization, family abandonment, among others. Therefore, this work finds its motivation in the legal perspective, by understanding the current scenario of Juvenile Justice and its challenges for its improvement.
