Venezuela Madura: uma discussão entre soberania estatual e intervenção humanitária internacional na ausência da atividade autorizativa do Conselho de Segurança da ONU

Abstract

Throughout this undergraduate thesis, some questions will be contemplated about international sovereignty and its mitigation through the use of humanitarian interventions taking as example the political, economics and humanitarian crisis that inflicts Venezuela. The humanitarian intervention is a kind of international intervention that focus the human rights context. As any other intervention, its application should take place beyond the Security Council of the United Nations legitimacy or at least be guided by the Security Council. However, In Venezuela ́s case, it’s possible to notice that UN ́s measures have more conservative and humanitarian purposes up until now, not showing any signs of interest in interventionists measures. States, such as Brazil and the U.S, has seen this position as a lenient posture, increasingly show displeasure in the absence of measures by the Security Council. With more and more American and Brazilian interventionists measures arising surrounding the Venezuelan territory it will be necessary to question the legitimacy of these countries to proclaim a humanitarian intervention in Venezuela by themselves, as the Security Council did not take any interventionists measures up to this point. Following the Public International Law, it is possible to notice that the Security Council have the exclusive legitimacy towards proclaiming or maintaining international interventions, being impossible for any other country usurp this competence. This undergraduate thesis will objectify providing a good understanding about the international relations between sovereign States, about the organization and operation of the UN and the UN ́s Security Council. In addition, there will be appointments towards the humanitarian intervention such as its relation with the humanitarian interference principle and the self-defense act, also it will be explored the legitimacy of the application of humanitarian interventions and the (im) possibility of its application in Venezuela ́s case. To develop this research in such a deep and profound way, it has been used the hypothetical-deductive method, therefore it has descriptive nature and bibliographic and documental nature as well.
