As audiências virtuais e a promoção de acesso à justiça durante o contexto da pandemia causada pela covid-19

Abstract

This scientific research has an analysis of the context of pandemic caused by COVID-19 and its implications in the justice system, focusing on the holding of virtual hearings in the search for continuity of judicial provision. In this sense, the present work aims to analyze whether the realization of this model of hearings is effective, or if it guarantees the guarantee of access to justice. For this, initially there is an analysis about the changes in the civil process over time, as well as the emergence of the pandemic and the guarantee of access to justice as a fundamental right. Subsequently, the benefits arising from the progressive virtualization of the civil process are analyzed, such as the advent of the PJe in the search for debureaucratization, speed and procedural economy, in addition to online methods of conflict resolution. Furthermore, there is an analysis of the principles that are impaired by the holding of this type of hearing, as well as the harms that can compromise the guarantee of access to justice. Thus, the results achieved seek to identify the reality experienced by a portion of the jurisdictions, which are not encompassed in the respective model found to hold hearings. The research is classified as bibliographic and documentary, using the hypothetical-deductive method.
