A criminalização do bullying na reforma do código penal

Abstract

This paper will analyze the concepts attributed to bullying and some of the ways in which it is practiced, both in the real and collective environment and in the virtual and social environment, analyzing not only the concept of harassment, but also some of the cases and effects attributed to society by its actions, trying to understand and present how the Brazilian legal system provides adequate sanctions for the criminal behavior of the bullying aggressors. The applicability of criminalizing the phenomenon of bullying as a response to society's demand for the protection of new legal assets based on the theory of the extension of criminal law, as well as the analysis of the functions that the globalized media performs in the social environment, it will be defined whether criminalizing harassment behavior represents a safety measure capable of reacting against this violence, or whether the initiative is simply an additional effect of maximum criminal law and, therefore, an aggression against the principle of minimum intervention. This work was carried out through a descriptive search with literature and bibliography review, through books and digital platforms such as Google Books, Google SciElo, Google Academic, among others, in order to show the effects of the actions and demonstrate that society has recently sought possible interventions in the field of criminal law and criminal justice.
