Trabalhador portuário avulso e a questão da contratação prioritária ou exclusiva dos registrados no órgão gestor de mão de obra - OGMO

Abstract

The present work intends to analyze the changes that occurred with the repeal of the Law nº 8.630/93 (BRAZIL, 1993) by the Law nº 12.815/13 (BRAZIL, 2013) regarding the attachment of the independent port worker. For this, the categories of the port workers were analyzed initially before the appearance of the Law nº 8.630/93, bringing the historical context of these workers until the appearance of the Law nº 12.815/13, showing their evolution with respect to the modalities of independent port workers as in relation to the relationship between independent port worker and the Workmanship Management Agency - OGMO. In the sequence, the workmanship is analyzed in the ports, mainly in the organized ports that is given through the OGMO, showing the attributions of this agency, how it is formed and what its importance for the category of the independent port workers, for the finally, it should be verified that the linkage of the independent port workers must be made exclusively or priority among the workers registered in the OGMO, thus revealing decisions and judgments on the matter. From this analysis, it is sought to reveal the best way of linking the workmanship so that the port operation is carried out successfully, agility and safety for all.
