| metadata.dc.description.resumo: | O contrato de trabalho intermitente desponta como reflexo da flexibilização das leis trabalhistas, com inclusão ordenamento jurídico brasileiro a partir da Reforma Trabalhista ocorrida em 2017. Objetiva-se confrontar o contrato de trabalho intermitente com a função finalística do contrato individual de trabalho. Metodologia bibliográfica, por meio da qual foram apurados aspectos formais do contrato de trabalho intermitente, a função teleológica do direito do trabalho e a função social do contrato individual de trabalho. Os resultados encontrados foram de que o contrato individual de trabalho possui função social de proteção da sociedade contra formas cruéis de exploração da mão de obra humana ao inserir garantias indisponíveis a todo trabalhador formal, enquanto o contrato de trabalho intermitente cumpre com as exigências formais justrabalhistas sem ocupar-se com o cumprimento da destinação social. A conclusão alcançada foi que o contrato de trabalho intermitente não cumpre com a função social própria do contrato individual de trabalho. |
| Resumo: | The intermittent labor contract emerges as a reflection of the flexibilization of labor laws, including Brazilian legal system from the Labor Reform occurred in 2017. The objective is to compare the intermittent work contract with the finalist function of the individual work contract. Bibliographical methodology, through which formal aspects of the intermittent work contract were determined, the teleological function of labor law and the social function of the individual work contract. The results found were that the individual labor contract has a social function of protecting society against cruel forms of exploitation of human labor inserting guarantees that are unavailable to every formal worker, while the intermittent work contract meets the formal requirements of the workers without attending to the social destination. The conclusion reached was that the intermittent labor contract does not fulfill the social function proper to the individual labor contract. |
