Liberdade de expressão religiosa e democracia: a representatividade parlamentar evangélica e o respeito ao Estado laico

Abstract

The following academic paper intends to examinate if the bancada evangélica’s religious speech inside the Parliament is according to the political representation held and the secularism imposed by the Constitution of 1988. For this purpose, the hypotesis created was that the bancada evangélica’s speech is not following the meaning of political representation and secularism imposed by the Constitution. In this way, the objective is to analyse the bancadas evangélica action facing political representation and the concept of state secularism imposed by the Constitution. The paper was divided in three parts, which the first one set out the religious freedom, its holder, adressee, subjective and objective dimension, and the state secularism. Afterward, the second chapter is adressed to the concept of democracy and its species by Robert Dahl, focusing in the representative democracy, and the definition of political representation by Hanna Pitkin. In the last chapter, with the intention of avaliate the bancada’s evangélica activity in the congress, it is analysed the bill no 674/07 and its votes in the Family and social security funding comission, by the law makers of bancada evangélica, such speech being analyzed for religious freedom, the state secularism and the political representation that legitimize their position. The final conclusion intends to certify whether the bancada ́s speech is in compliance with the Federal Constitution or not. The deductive approach method was utilized, along with the monografic research technique and bibliographic analysis done, literature revision and direct data analysis.
