“In dubio pro stereotypo”: analisando o impacto da cultura do estrupo em decisões judiciais

Abstract

Rape culture is understood as the naturalized repetition of a social imaginary that aims to objectify female bodies and discredit victims of sexual violence. It is possible to characterize it as the basis of gender violence in Brazil, thus obtaining its influence in the judiciary as well. The main objective of this monograph is to analyze how the gender stereotypes pervasive in the rape culture influence the judicial sentences of trials for crimes that deal with sexual violence committed against women. This, taking into account the presentation of situational data about this type of criminal offense in the country and sentences exposed by the work of Gabriela Almeida and Sérgio Nojiri, which bring the real demonstration of a judiciary that repeats the narratives that recreate gender stereotypes supported by the “Rape Culture”.
