Trabalho infantil na contemporaneidade: a possibilidade de regulamentação dos influencers mirins à luz dos direitos infantojuvenis

Abstract

This study explores the new ways of working brought about by the digital age, carried out by so-called digital influencers. Regardless of age, these new forms are also being practiced by children and adolescents without adequate regulation for their exercise. Thus, emphasizing that although the legal system values the full protection of children and adolescents, the legislation remains inert in the face of this reality that can have incisive consequences for the childish public in the short and long term. The main objective of the work is to address the need for legislation aimed at regulating the activities of this public as a viable alternative, providing for flexibility and instituting parameters that rule out possible violations. Thus, it was necessary to point out how child labor took place over the years, reaching the internet, which can cause consequences such as mental and social ones. In addition, French legislation stood out with its own rule on the subject, which provided for ways of dealing with and inspecting the exercise of these activities. Thus, there is a need for a national regulation in order to resolve any questions and allow effective inspection. The exposed work uses the bibliographic research model, seeking to demonstrate the need for relevant legislation, which is exploratory and descriptive, where already published material is used, such as theses and articles, in a hypothetical-deductive character, where interviews were carried out with professionals area, seeking greater engagement with the problem, aiming to integrate the knowledge thus obtained with society.
