Pele alva e pele alvo: racismo e a seletividade do sistema penal, uma análise a partir da Teoria Criminològica Labelling Approach

Abstract

This study aims to discuss the relations between the Brazilian criminal system from the perspective of the Labelling Approach theory and racism. To this end, the labelling approach theory is explained, which brings the idea that the figure of the criminal emerges from a labelling performed by the members of society themselves, who define what they consider to be the ideal conducts and typify those who go against their ideals. The social labels are a reflection of this power scheme, that is, it implies directly in the institutional segregation of the marginalized, besides being inert before the situations of deprivation of fundamental rights of the stigmatized individuals. At the end, it discusses racism historically, making an analysis of the extension of the stigmas of racism in Brazilian society, besides paying attention to the consequences caused to target groups of the practice of racism and how this corroborates to the institutionalization of racism and reinforces the exclusion and marginalization of the black population.
