A proteção internacional dos direitos humanos dos refugiados no cenário da pandemia da covid-19

Abstract

The present work approaches the international protection of the refugee population amid the new coronavirus pandemic. In this context, the refugee’s condition of vulnerability increases since there is the absence of policies which are related to the protection of their basic rights, especially health, and also the state policies on the virus containment which are orientated towards movement restriction and settlement. Therefore, the present work has the purpose of analyzing international mechanisms about the refugee’s rights protection from a historical timeline which was initially restricted to Europe before and after the First World War as well as understanding the main impacts from Covid-19 Pandemic on the effectiveness of the refugee’s rights. In addition, it is necessary the identification of the international responsibility of the states which are signatories of the human rights treaties and international conventions, especially the New York Declaration (2016) which is the most recent document in this area from soft law nature. There is in the document a diplomatic vision about the question of the refugees which is connected with political questions of the host states. Thus, it approaches the international commitments which comes from these international documents and the responsibility from the signatory states in elaborating public policies which supports this vulnerable social group in a global scenario of sanitary crisis. Therefore, research was developed through the hypothetical-deductive method and its procedement was done by bibliographic approach because it includes multidisciplinary bibliography in a way to approximate the researcher and his study object with the intention to propitiate them with new approaches about the theme in analysis.
