Violência no futebol: a responsabilidade civil das entidades desportivas pelos atos de violência física praticados por torcedores

Abstract

The soccer is a popular sport worldwide, especially in Brazil, considering the enormous average attendance at all matches in stadiums. However, on the other hand, there are problems present in this environment, and the main issue is physical violence in soccer. In this regard, the research with bibliographic methodology seeks to analyze the responsibility of sports entities regarding these cases that occur in the soccer environment, investigating first the nature of soccer violence and its historical context, which will go through the issue of organized fan groups and address a tragedy resulting from this violence. Next, an analysis will be made based on legislation, specifically sports law, in connection with the Consumer Protection Code to investigate this responsibility, as well as its need for effectiveness. Additionally, the responsible role of entities in relation to the measures that must be taken regarding this responsibility to prevent these acts from continuing to occur in the day-to-day of the sport will be explored. Thus, it can be concluded that this responsibility is objective, and entities must respond regardless of the existence of fault precisely because of the interconnected aspect of the consumer relationship between them and the fans.
