| metadata.dc.description.resumo: | O objeto da presente pesquisa se baseia na análise do controle judicial de políticas públicas tendo a via judiciária como intercessora na determinação de medidas concretas e políticas públicas na garantia do direito à saúde no contexto da ADPF 672. Trata-se de uma pesquisa cujo referencial teórico baseou-se em análise bibliográfica e documental, fundada em livros, teses, artigos, jurisprudência e legislação. O sumário dividiu-se em três capítulos, o primeiro recai sobre o estudo dos direitos fundamentais, perpassando pelo entendimento de direitos humanos e sociais até chegar à proteção social da saúde e o conceito de políticas públicas, essencialmente às de saúde e a utilização do judiciário no controle dessas políticas públicas. O segundo capítulo dedica-se ao estudo do papel do Poder Judiciário e a discricionariedade legislativa e judicial, bem como à análise da separação dos poderes e a influência do poder judiciário na saúde coletiva, assim como as atribuições dos entes federativos em matéria de saúde, com foco na judicialização da saúde como alternativa para garantia de direitos sociais. Por fim, o terceiro capítulo incide sobre o estudo da judicialização da política e o Supremo Tribunal Federal, analisando o controle de constitucionalidade frente à interpretação de dispositivos normativos conforme a Constituição Federal de 1988, e o papel do Supremo Tribunal Federal no fortalecimento do pacto federativo no julgamento da ADPF 672. Justifica-se a presente pesquisa, tendo em vista a relevância e importância do tema na sociedade. Trata-se de um direito fundamental, que tem sido constantemente violado pelo poder público, principalmente no atual cenário de crise político-econômica. Propõem-se, assim, uma reflexão acerca do papel do judiciário na concretização do direito fundamental à saúde. |
| Resumo: | The objective of this research is based on the analysis of the judicial control of public policies, with the judicial route as an intercessor in the determination of concrete measures and public policies to guarantee the right to health in the context of ADPF 672. This is researching whose theoretical framework was based on bibliographic and documentary analysis, founded on books, theses, articles, jurisprudence and legislation. The summary was divided into three chapters, the first focuses on the study of fundamental rights, going through the understanding of human and social rights until reaching the social protection of health and the concept of public policies, essentially health policies and the use of the judiciary in the control of these public policies. The second chapter is dedicated to the study of the role of the Judiciary and legislative and judicial discretion, as well as the analysis of the separation of powers and the influence of the judiciary on public health, as well as the attributions of the federative entities in health matters, focusing on the judicialization of health as an alternative to guarantee social rights. Finally, the third chapter focuses on the study of the judicialization of politics and the Federal Supreme Court, analyzing the control of constitutionality in the interpretation of normative provisions according to the Federal Constitution of 1988, and the role of the Federal Supreme Court in strengthening the federative pact in the judgment of ADPF 672. This research is justified in view of the relevance and importance of the topic in society. It is a fundamental right that has been constantly violated by the public authorities, especially in the current scenario of political and economic crisis. Thus, we propose a reflection on the role of the judiciary in the realization of the fundamental right to health. |
