Inteligência artificial generativa na produção científica e direito autoral: autoria, transparência e responsabilidade à luz da Lei nº 9.610/1998

Abstract

This monograph analyzes the legal challenges arising from the use of generative artificial intelligence in Brazilian scientific production, focusing on authorship, transparency, and academic responsibility under Law No. 9,610/1998. The general objective is to examine the sufficiency of Brazilian Copyright Law in addressing these challenges and to propose normative guidelines compatible with academic integrity and legal certainty. The research adopts a qualitative, bibliographic, documentary, and legal-dogmatic approach, with an analytical and propositional purpose. It is based on the hypothesis that Brazilian copyright legislation remains relevant to affirm the centrality of human authorship, but is insufficient to regulate specific duties of transparency, traceability, and disclosure of generative AI use. Ultimately, the study demonstrates the need to preserve meaningful human intellectual intervention, critical verification of sources, and the researcher’s full responsibility for the final content.
