O antes, o agora e o depois: a condição jurídica do refugiado no Brasil a partir da edição da lei 9.474/1997

Abstract

The present assignment aims to discuss the legal protection of refugees in Brazil from the law 9.474/1997, making a parallel between three moments, before the normative instruments of international and national protection, the actuality of these instruments and the perspectives of refugee protection in the face of political uncertainties. The present research was of a descriptive character, where it was analyzed how the protection of refugees arose, especially in Brazil with the edition of the law 9.474/1997, with a bibliographical character, starting from specialized works of law and international and national laws. Initially, the conceptual construction of the refugee is presented, starting from a historical context until the edition of normative instruments like the 1951 Refugee Convention, the 1967 Protocol and the 1984 Cartagena Declaration. Next, we discuss the protection of refugees from the Federal Constitution of 1988 and the edition of Law 9.474/1997, the process of granting refugee status, and the body responsible for this process. Lastly, the prospects for refugee protection are highlighted, as they relate to Human Rights and International Humanitarian Law, as well as measures aimed at integrating and ensuring dignified conditions for refugees.
